This paper will discuss the scenario of thirteen-year-old Davis of Option 1. Allow me to give a brief overview of Davis’s situation through the eyes of wisdom. Although the legal situations with Davis’s father and brother are not detailed in the summary, it is safe to assume that both men had felony criminal records before their current prison bids of assault and armed robbery. Due to the lack of strong fatherly and male leadership, Davis and his mother were forced into an economic situation of living in run down, poorly built government housing, in a crime ridden neighborhood filled with other African American youth whose fathers were in prison, or whose parents were toxic and abusive towards each other: Erin Pougnet, Lisa A. All power is given to the discretion of the judge, who benefits financially from the more people locked behind bars in American prisons. It will be demonstrated in this paper that according to peer reviewed and government funded psychological study, Davis should in no wise be tried as an adult, but instead put through a rigorous and custom rehabilitation program, paid for by the same government funds that would have been used to keep him in prison.
The judiciary system has been and is established by the United States of America federal governing body. Each state has freedom to determine at what age and under what circumstances in which juveniles can be tried as adults. This of course is simply a lie, as we have documented the severe conflict of interest created when the governmental penal system joins hand in hand with private corporations who increase their profit the more prisoners are locked behind bars.
In order to properly diagnose or come to a true and logical conclusion on any matter, one must dig as far back into history as is relevant to the case at hand. The fact that Davis lives in an African American community, riddled with crime and publicly assisted housing, tells us that this unnatural state of African American life must be explained through the lens of history, otherwise improper conclusion about the behavioral nature of African American people can be deduced. During the Ronald Reagan administration, the U.S. Federal government not only funded the Nicaraguan Contras, a rebel military group against the Nicaraguan government, but funded the lucrative cocaine trade, which landed cocaine into the neighborhoods of African American communities across the Country: The National Security Archive. 1996. This activity by the Federal government stifled the foundation of the Black community in America in all major cities. Because of his societal conditions, and the conditions of his parents, young Davis obviously never developed strong attachment to either of his parents. According to the Attachment Theory, made popular by John Bowlby in the late 1950s, children must develop a strong feeling of closeness, security, love, and trust between them and their parents in order for them to fully develop. A lack of spiritual or soul attachment in a good and wholesome way, particularly with the mother in early childhood, and with the father in later childhood, causes lifelong character flaws, physical ailments, and arrested development in one form or another.
The Attachment Theory teaches that children associate certain behaviors, sounds, smells, situations, and all manner of stimuli to certain interactions with parents or primary caregivers during their childhood. In Davis’s case, drugs, gangs, cursing, chaos, murder, and disorder were the only things that he could associate with his parents and immediate family. This caused Davis to not only follow in the footsteps of many around him, but to undoubtedly ignore and excommunicate any positive person from his life. Since his attachments from birth only consisted of negativity, this is what he became drawn to. Subconsciously he associated struggle and an unproductive lifestyle with his very essence. Because Davis lacks true self-confidence and security within himself, he overcompensated through a violent and destructive life path. Had he been positively attached to his mother and father through love, peace, order, and encouragement, this entire situation had not happened. Because Davis’s brain is still not fully developed at 13 years of age, he cannot be held accountable for this action. There are no human beings in whom the factual Attachment Theory does not apply. Therefore, it is the job of the governors of our land to construct a society in which all children are positively attached to either their parents of primary caregivers in order to alleviate these situations. Although the Attachment Theory was made popular close to sixty years ago, the reader need not neglect their own common sense. Everything stated and documented through months and years of study is extremely basic and common knowledge to any wise human being. All wholesome and prosperous societies understood this concept, and it’s a shame and a wonder why many Americans have no understanding of the basics contained in this theory through their own self-reflection. America is headed down a dark path if there must be thousands of dollars given towards research to explain that which is common sense to those with living souls.
The Theory of Mind is extremely important in the case of young Davis. As children grow, they observe how certain situations are handled, how certain people respond to particular behaviors and actions, and what personal actions will cause one to respond is a desired way. The Theory of Mind alone should free young Davis from the entrapment of the Prison Industrial Complex. According to this widely accredited theory, people begin to develop the ability to understand and predict human behavior as early as age four. Surely the politicians, and leaders of this self-proclaimed great nation should have an advanced level of understanding or human behavior, including cause and effect. Surely it was understood by the framers of our culture and society, that when a government uses American tax dollars to fund guerilla soldiers and rebels in other countries, while simultaneously allowing massive amounts of cocaine to devastate Black communities across America, that children would be negatively affected. Therefore, not only should Davis not be tried as an adult, but the same tax dollars that were spent without the knowledge of the public, on militant rebel organizations in foreign lands, should be used instead to create rehabilitation programs and facilities for child victims of this grotesque excuse for social welfare we experience often in America.
According to Maslow’s Hierarchy of Needs, every child needs to start life with a firm foundation of physiological development, safety, and a feeling of love and belonging. Young Davis obviously had none of these things. Even his physiological development was stifled, and undoubtedly, Davis has many chemical and hormonal imbalances that also contributed to his life choices. According to author, Ken Magid, in the book, “High Risk: Children Without a Conscious”, children born into other that wholesome family and community environments develop physiological wounds that manifest in chemical imbalances and the increased absorption of toxic heavy metals and chemicals, which further alter normal brain function: Dr. Larry Wilson. Unless our leaders are willing to match the billions of dollars they use to fund the militarization of other nations and various terrorist organizations, with rehabilitation tax funded family and community organization classes and programs, there should no wise be an adult charge brought against young Davis.
In conclusion, a blind man can see that our child Davis should not be tried as an adult. Although the State of Michigan does routinely charge children as adults, this State has not done its part in structuring and orchestrating a fully functional and properly run society. This is obvious by the fruit in which the State of Michigan is bearing. When normal tax paying citizens go to work every day, their merit is based solely on the results that they produce for their employer. Employees who do not perform on the job are terminated. Our Federal and State governments are payed very well and are given unthinkable power, but seem to be the only paid workers in the land who can consistently produce rotten fruit, yet continue to reign supreme and even increase their wealth and power. Davis’s story is a reflection of the society, and society is a reflection of our elected and increasingly non-elected leaders. This fact along with the many completely logical and common-sense points expounded upon in this paper, we should all come to the conclusion that money should be spent to rehabilitate and heal the soul, mind, and body of young Davis, instead of it being spent on his incarceration.
